Terms of Service

These Terms of Service (General Terms and Conditions) govern the use of the Munter app, the website munter.app and the purchase of products in our shop. The provider is TRO GmbH Averio (“we”, “us” or “Munter”).

Service description

Munter is an alarm app that only stops an alarm once an NFC tag is scanned. In addition, we offer physical NFC tags for purchase through our shop.

Use of the app

We grant you a simple, non-transferable right to use the app for private purposes. All ownership and rights in the app remain with us.

The app is available via the Apple App Store and Google Play; the terms of the respective store apply in addition.

Account & optional sync

You can create an account for optional cloud synchronisation. You are responsible for keeping your login credentials confidential.

No guarantee of waking you up

Munter is not a substitute for a reliable wake-up mechanism for safety-critical purposes. Whether an alarm sounds depends on factors we cannot control (e.g. device settings, silent/Do-Not-Disturb mode, battery level, operating-system restrictions, hardware faults, volume).

We do not warrant that an alarm will trigger or wake you in every situation. To the extent permitted by law, we are not liable for damage resulting from an alarm that does not trigger or triggers late (e.g. oversleeping).

Shop: conclusion of contract

The presentation of products in the shop does not constitute a binding offer. By placing an order you make a binding offer; the contract is concluded upon our order confirmation or dispatch of the goods.

Prices & payment

The prices displayed at the time of the order apply, including statutory VAT, plus any shipping costs. Payment is made via the payment methods offered during checkout ([placeholder: payment methods/provider]).

Delivery & shipping

Right of withdrawal for consumers

Consumers have the right to withdraw from the contract for the delivery of physical goods within 14 days without giving reasons. The period begins upon receipt of the goods. To exercise it, a clear statement (e.g. by email to support@munter.app) is sufficient.

In the event of an effective withdrawal, we will refund payments without undue delay. The cost of return is borne by [placeholder: the customer / us].

Note: for digital content/services the right of withdrawal may lapse early if performance has begun with your consent.

Warranty

The statutory warranty rights under Austrian law apply.

Liability

We are liable without limitation for intent and gross negligence as well as under mandatory statutory provisions (e.g. product liability). Otherwise, liability for slight negligence is limited to the foreseeable damage typical for the contract, to the extent permitted by law.

Availability & changes

We strive for the highest possible availability but do not owe uninterrupted availability. We may further develop, restrict or discontinue the app. We reserve the right to amend these terms with effect for the future.

Dispute resolution

The EU Commission provides a platform for online dispute resolution. We are neither obliged nor generally willing to participate in dispute resolution proceedings before a consumer arbitration board.

Governing law & jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the consumer’s country of residence remain unaffected. The place of jurisdiction is, to the extent permitted, the registered seat of TRO GmbH Averio.
